IdentitySpark is a service operated by Spamrisk LLC ("we", "us", "our"), trading as IdentitySpark. We provide an AI-powered creative intelligence service that converts visual taste into brand systems, naming, campaign concepts, and copy frameworks. By using our service, you ("user") enter into an agreement with Spamrisk LLC.

By accessing or using IdentitySpark you agree to be bound by these Terms. If you do not agree, do not use the service. You confirm you have legal authority to enter this agreement, or are of legal age.

IdentitySpark provides AI-generated brand assets (taste profile, brand DNA, names, campaign concepts, visual direction, copy). Outputs are produced by large language models and may contain inaccuracies. You are responsible for verifying outputs before use, ensuring you have rights to any inputs you provide, and confirming names are not subject to third-party trademark.

You must not: (a) use IdentitySpark for unlawful purposes; (b) commit fraud, spam, or abuse; (c) infringe intellectual property of others; (d) attempt to interfere with security (probing, malware, scraping); (e) reverse engineer or resell the service; (f) use outputs to generate hate speech, deepfakes, or content prohibited by law; (g) submit prompts containing personal data of third parties without consent.

Outputs are generated by AI models and may be inaccurate, inappropriate, or unsuitable. Outputs are not legal, financial, or professional advice. You are responsible for reviewing all outputs and verifying they are appropriate for your use. We do not guarantee uninterrupted or error-free operation of the service.

You retain rights to outputs subject to the terms of the underlying AI providers. You must not use outputs to infringe third-party rights. We may suspend or remove content and accounts that produce or are used to produce abusive or infringing content.

You must provide accurate information and keep credentials confidential. You are responsible for activity under your account.

IdentitySpark and its software, designs, and trademarks remain our property. We grant you a limited, non-exclusive, non-transferable right to use the service in accordance with your active plan.

Payments are processed by Stripe. By purchasing, you also agree to Stripe's consumer terms. Applicable taxes are calculated and collected at checkout.

Subscriptions renew automatically until cancelled. You may cancel at any time from your account. Cancellation takes effect at the end of the current billing period.

We may suspend or terminate access immediately for: material breach of these terms, non-payment, security or fraud risk, or repeated or serious violations of acceptable use. On termination, your right to access ceases. Generated content you have already saved remains yours.

To the maximum extent permitted by law, IdentitySpark is provided "as is" without warranties of any kind. Our aggregate liability is limited to the fees paid by you in the prior 12 months. We exclude liability for indirect, consequential, or special damages, except where carved out by law (fraud, death, personal injury).

You agree to indemnify IdentitySpark against claims arising from your use of the service, your inputs, your outputs' use, or any breach of these terms.

We may update these Terms. Continued use after changes constitutes acceptance.
